In order to be clear we publish our terms of conditions that you accept when contacting us in order to sail with us.Hence visiting this site or any other site that point and link to this one or contacting us means you accept our terms & conditions.

You acknowledge that you have voluntarily applied without compensation and without commercial purpose to participate in a sailing trip. In consideration for your voluntary participation in sailing activities associated with the La Poste Sailing Club (including Sailing Club),you hereby forever waive, release and discharge the La Poste Sailing Club,his captain, its affiliates, and their respective members, managers, employees, volunteers, officers, directors, agents, representatives, successors and assigns (each a “Released Party”) from any and all claims, demands, damages,refunds, judgments, executions, rights of action or causes of action, present or future, whether the same be known, anticipated or unanticipated, which a Releasor may have, or claim to have, against any Released Party resulting from death, personal injury,delays, cancellations of the trip, property damage or other loss Releasor may sustain as a result of participating in any sailing activity associated with the La Poste Sailing Club, other related activities (including land-based activities), or the use of the La Poste Sailing Club’s equipment and facilities.
THIS RELEASE IS INTENDED TO DISCHARGE EACH RELEASED PARTY FROM ANY AND ALL LIABILITY ARISING OUT OF OR CONNECTED IN ANY WAY WITH PARTICIPATION IN SAILING ACTIVITIES ASSOCIATED WITH THE La Poste Sailing Club, EVEN IF THAT LIABILITY RISES OUT OF NEGLIGENCE OR CARELESSNESS ON THE PART OF ANY RELEASED PARTY.
you declare to sail from without compensating LaPoste Sailing CLub and his staff for that purpose, any exchange of money is solely due to share expenses (food, water, gasoline, taxes, etc) Any extraordinary cost will be shared between the participants.
Any decisions about hours and dates of departures, delays, cancellation of any leg of the trip, included the trip itself, for meteorological, safety or any other reason, is done solely and without any prior approbation, consultation with the participants by the Released Party.
Our main sailing boat is the famous La Poste Maxi Ketch and we will use mainly this vessel, but if for any reason the La Poste Maxi Ketch is not available we will use another sailing boat for the trip, usually we use if possible the same class of boat. In case of differences between classes there will be no refund or remboursement.
Delays, changes of plans, hours and dates, menus, excursions or will be communicated to the participants in advance if possible, if the participants does not agree with the new terms no refund or reimbursement will be done.
Releasors hereby acknowledge that serious accidents occasionally occur during sailing activities and that mortal or serious personal injuries and/or property loss/damage or other loss may result from participation in sailing activities, including further injury or damage sustained as the result of the efforts of third parties who come to the aid of Participant.
The participants confidential informations WILL NOT be shared with any other third parties, and the participants agree to maintain confidential any informations about La Poste Sailing Club,his captain, its affiliates, and their respective members, managers, employees, volunteers, officers, directors, agents, representatives, successors and assigns (each a “Released Party”) and any agreements between the released party and the participant.
Releasors hereby agree to indemnify and hold harmless the Released Parties for claims, demands, damages, judgments, executions, rights of action or causes of action relating to any such injury or damage.
La Poste Sailing Club,his captain, its affiliates, and their respective members, managers, employees, volunteers, officers, directors, agents and representatives have the right to terminate the status of any participants, for security or any other reason we hold the right to modify, delays or cancel your participations without any refund whatsoever.
Participant hereby agrees to pay the La Poste Sailing Club for the expenses due in order to arrange the sailing trip.
In order to book the trip is required one or more payment, usually the first one is a 10% of the total just to book the trip.
Sometimes we can ask for a second one as low as 10% or ass high as 50% in order to buy food, beverages, fuel and all needed for the trip.
Payments will be asked to be done via western union and the transfer fee is at your charge.
The participants agree to make the payments when asked by La Poste Sailing Club,his captain, its affiliates, and their respective members, managers, employees, volunteers, officers, directors, agents or representatives. Refusal to make the payments will result in cancellation of the participation of the participants and no refund or remboursement will be done.
Last payment is done the morning of the departure.
Taxes, import and export fees, and any extra charges will be paid by the participants as decided by La Poste Sailing Club,his captain, its affiliates, and their respective members, managers, employees, volunteers, officers, directors, agents, representatives, successors and assigns (each a “Released Party”)
Any vehicles as bike or motorcycles that will travel with one or more participants will be stored and loaded with the supervision and responsibility of his owner .
La Poste Sailing Club,his captain, its affiliates, and their respective members, managers, employees, volunteers, officers, directors, agents, representatives, successors and assigns (each a “Released Party”) will not be held responsable to any damage to any vehicles as bike or motorcycles that will travel with one or more participants.
Also the loading and unloading fees of any vehicles as bike or motorcycles that will travel with one or more participants will be paid by his or her owner.
Taxes, import/export fees, loading and unloading fees of bikes are at the charge of the owner of such bike.
The participant agree to be ready with all the documentation in time for departure, this mean to be in the country in advance in order to fulfill all legal obligations. The La Poste Sailing Club,his captain, its affiliates, and their respective members, managers, employees, volunteers, officers, directors, agents or representatives reserves the right to refuse at any moment any participants, his bike or vehicles if not compliant with security standards or any other consideration.
If the participant decide not to travel with us or any other boat we provide will not be refunded of his deposit and will be held liable for the total cost of his participation in the trip itself.
Bikes must be loaded on board without any fluids on board and will be protected by seawater by the owner.
Participant hereby agrees to pay the La Poste Sailing Club for loss or damage due to Participant’s intentional, negligent, or careless use or misuse of equipment (including boats) or facilities. Participant further agrees to abide by all rules and instructions of the La Poste Sailing Club or its representatives or agents relating to participation in sailing activities associated with the La Poste Sailing Club and Participant agrees that his or her the failure to observe and obey such rules may result in revocation of the right to participate in any such activities without further recourse and refund. I agree also not to transport weapons, firearms, illicits drugs, contraband, paying passengers and animals.
We may update this terms at any moment so please read it before sailing with us.
Ustedes , entiende y acepta que La Poste Sailing Club, promotores de este evento, así como los patrocinadores, sus empleados, oficiales y voluntarios o mandatarios (de ahora en adelante “las partes descargadas de responsabilidades”) no pueden ser considerados como responsables de ninguna manera en caso de herida, lesión física o psicológica, muerte, u otros daños en lo que me concierne, daños de sus propiedades, vehículos etc , daños cual pueda resultar por la participación de mi persona o asistencia en esta actividad, por responsabilidad de cualquier producto o por la negligencia de mi persona u otra persona, incluyendo las partes descargadas de responsabilidades que sean activas o pasivas.
Ademas La Poste Sailing Club, promotores de este evento, así como los patrocinadores, sus empleados, oficiales y voluntarios o mandatarios no pueden ser considerados responsable de retardos, cancelaciones, substituciones de barcos; y en cualquier caso el rembolso de los gastos compartidos o adelantos serán a total discreción de La Poste Sailing Club, promotores de este evento, así como los patrocinadores, sus empleados, oficiales y voluntarios o mandatarios.
Al aceptar estas condiciones ustedes certifica que su persona se encuentra en buen estado mental y buena salud la cual es adecuada para este evento, que no estas bajo la influencia del alcohol, tampoco bajo la influencia de droga cualquiera que son contradictorias con sus declaración. Si estas tomando medicamentos, certifica que consultó un médico y que tiene su aprobación para participar en esta actividad, mientras estas bajo la influencia de la medicina o medicamentos. Está totalmente prohibido embarcar armas, estupefacientes, contrabando en general, mercancías, pasajeros de pago y animales.
